Arizona Sexual Offenses
There are numerous sex crimes you can be charged with depending on the specific allegations, including but not limited to:
- Indecent exposure: This offense encompasses the exposure of your genitals, anus, or breasts to another person when you were reckless about whether the other person would be offended. If the other person was older than 15, this is a Class 1 misdemeanor. If the other person was younger than 15, or if you have previous convictions, it is a Class 6 felony.
- Public indecency: Public sexual indecency includes intentionally or knowingly engaging in a sexual act when another person was present, and being reckless about whether that person would be offended. This is a Class 1 misdemeanor, unless it involves a minor, in which case it is a Class 5 felony.
- Voyeurism: If there is evidence you knowingly invaded the privacy of another person without that person's knowledge or consent for the purpose of sexual stimulation, then you can be charged with voyeurism. Depending on the circumstances, this is a Class 5 or 4 felony.
- Unlawful disclosure of nude or sexual image: It is illegal to intentionally disclose an image of another person who is identifiable if that person is nude or engaged in a sexual activity, he or she had a reasonable expectation of privacy, and/or the image was disclosed with the intent to harm, harass, intimidate, threaten, or coerce. This can be a Class 5 or 4 felony.
- Prostitution: Engaging in prostitution is a Class 1 misdemeanor in Arizona.
- Sexual abuse: You can be charged with sexual abuse if there is evidence you intentionally and knowingly engaged in sexual contact with anyone 15 years or older without that person's consent, or with a minor under 15 if the abuse only involves contact with female breasts. This is a Class 5 or 3 felony.
- Sexual assault: You can be charged with this offense if there is evidence you intentionally or knowingly engaged in sexual intercourse or oral sex without the other person's consent. This is a Class 2 felony, and the statute lays out the statutory minimum and maximum punishments.
- Sexual conduct with a minor: You can be charged with a crime if there is evidence you intentionally or knowingly engaged in sexual intercourse or oral sex with a person under 18. This can be a Class 6 or 2 felony.
- Molestation of a child: If there is evidence you intentionally or knowingly engaged in or caused a person to engage in sexual contact with a child who is younger than 15, you will be charged with molestation of a child, which is a Class 2 felony.
